These Terms of Service (“Terms”) govern the use of the TCPA Complaint Form (“Form”) provided by 5th Qtr Wealth Group LLC (“Agency,” “we,” “our,” or “us”). By submitting a complaint through this Form, you (“User,” “you,” or “your”) agree to the following:

1. Purpose of the Form

The Form is intended to allow clients, policyholders, and other individuals to report concerns regarding insurance-related communications that they believe may not comply with the Telephone Consumer Protection Act (TCPA) or applicable communication regulations.

This includes, but is not limited to:

  • Calls or text messages related to policy information, billing reminders, or claims,

  • Marketing or promotional insurance offers,

  • Appointment confirmations or reminders.

2. Information You Provide

By submitting a complaint, you agree to provide accurate, complete, and truthful information, including:

  • Your name and contact information,

  • The phone number that received the communication,

  • The date, time, and content of the message or call in question.

You acknowledge that:

  • False or misleading complaints may result in dismissal and potential referral to authorities,

  • The information provided may be used to investigate and address your complaint.

3. Use of Information

  • Complaint details will be used solely for compliance monitoring, resolution, and reporting.

  • We may share complaint information with our carriers, service providers, or regulators if required by law.

  • Submitting a complaint does not create a client-agent, fiduciary, or attorney-client relationship.

4. Complaint Review & Resolution

  • Our Compliance Team will investigate complaints in a reasonable timeframe.

  • If a violation is identified, we will take corrective actions consistent with TCPA and internal compliance policies.

  • While we treat all submissions seriously, resolution does not guarantee financial compensation.

5. Non-Retaliation

We will not retaliate against any individual who submits a complaint in good faith regarding insurance-related communications.

6. Limitation of Liability

  • 5th Qtr Wealth Group LLC is not liable for any damages, claims, or losses arising from use of this Form or from communications sent in compliance with your consent.

  • Use of this Form does not guarantee any legal outcome or resolution.

7. Consent to Follow-Up

By submitting this Form, you consent to receive follow-up communications from us regarding your complaint. Such communications may include calls, text messages, or emails strictly related to the resolution of your submission.

8. Governing Law

These Terms shall be governed by and construed under the laws of the state of Florida, without regard to conflict of law principles.
